PLANNING COMMISSION

Minutes-April 26, 2007

The regularly scheduled meeting of the Jefferson County Planning and Zoning Commission was held on April 26, 2007, at 7:00 p.m. in the Assembly Room of the Jefferson County Administration Center, 729 Maple Street, Hillsboro, Missouri.

The following members of the commission were present:

Tim Dugan
Donald Geatley
Tom Dismuke
Jesse Ford
William Koehrer
Charlie Lesch
Mike Price

Also present were Martin Toma, Director of Land Use, Development and Code Enforcement, Kristi Bales, Assistant Director of Land Use, Development, and Code Enforcement, Matthew Ament, Planner III, Justin Randall, Planner II, Elaine Roesch, Recording Secretary, Marc Fried, County Counselor, members of the press and other concerned citizens.

The first item of new business was approval of the agenda.

Commissioner Price made a motion for approval of the amended agenda. Commissioner Lesch seconded the motion. Motion carried with all in favor.

The next item of New Business was approval of the April 12, 2007 minutes.

Commissioner Dugan made a motion for approval of the April 12, 2007 minutes. Commissioner Ford seconded the motion. Motion carried with all in favor.

Ms. Bales presented the following exhibits for all the petitions:

Exhibit A The Jefferson County Comprehensive Master Plan
Exhibit B The Zoning Order
Exhibit C The Subdivision Regulations
Exhibit D Staff Reports with respective case files
Commissioner Geatley made a motion to accept the presented exhibits. Commissioner Price seconded the motion. Motion carried with all in favor.

The first item of Old Business for Consideration was CM107006, a Zone Change Request for parcel 06-7.0-35.0-1-001-008. 03 located at 8343 Highway B, east of Highway 30 and south of Cedar Hill Road, in Meramec Township, from Rural Residential (RR2) Zone District to General Commercial (CM1) Zone District.

Mr. Randall presented the staff report for CM107006:
The following individual testified in favor of CM107006:

Commissioner Geatley made a motion that the Jefferson County Planning and Zoning Commission finds that the proposed zoning is in accordance with the General Commercial (CM1) Zone District and recommends approval of CM107006. Commissioner Price seconded the motion.
Chairman Dismuke called for a roll call vote. The results were as follows:

Motion for approval of CM107006 carries 4-3.

The first item of New Business for Consent was FP05059 was, a Final Plat for San Marino Plat One, parcel 02-2.0-03.0-1-001-087., located east of Highway 141 and northwest of Old Highway 141, south of Claraned Heights and north of Brethold , in Rock Township.

Commissioner Price made a motion for approval of consent agenda. Commissioner Geatley seconded a motion.
Motion carried with all in favor

The next item of New Business for Consideration was PP07030, a Preliminary Plat for Stonebridge Subdivision, parcels 19-7.0-26.0-002., 19-8.0-27.0-001., and part of 19-8.0-28.0-001., located northeast of I-55 and Highway 61 intersection, off River Cement Road, south of Festus, in Plattin Township.

Mr. Ament presented the staff reports for PP07030 and VR07045

The following individual testified in opposition of PP07030 and VR07045:
Drew Null – who presented exhibit E, a letter signed by adjoining property owners, presenting their concerns regarding the variance request.
Commissioner Dugan made a motion to accept Exhibit E. Commissioner Price seconded the motion.
Motion carried with all in favor.

Commissioner Koehrer made a motion that the Jefferson County Planning and Zoning Commission recommend approval of PP07030, the preliminary plat for Stonebridge Subdivision, subject to regulatory requirements, and preliminary plat conditions as stated in staff report. Commissioner Ford seconded the motion. Motion carried with all in favor.

The next item of New Business for Consideration was VR07045, A Variance Request for Stonebridge Subdivision, parcels 19-7.0-26.0-002., 19-8.0-27.0-001., and part of 19-8.0-28.0-001., located northeast of I-55 and Highway 61 intersection, off River Cement Road, south of Festus, in Plattin Township, for relief from Article V. Section 5.13 Drainage and Storm sewers, of the Jefferson County Subdivision Regulations.

Commissioner Price made a motion that the Jefferson County Planning and Zoning Commission recommend approval of VR07045 subject to conditions stated in staff report. Commissioner Ford seconded the motion.
Motion carried with all in favor.

The next item of New Business for Consideration was CM107041, a Zone Change Request for parcel 23-2.1-03.0-011., located at 13219 State Road CC, in Plattin Township, from Residential (R20) Zone District to General Commercial (CM1) Zone District.

The following individual testified in favor of CM107041: Austin Townsend
The petitioner stated he wish to amend his petition from General Commercial (CM1) Zone District to Commercial Services (CS2) Zone District.
Commissioner Geatley made a motion that the Jefferson County Planning and Zoning Commission recommends approval of CM107041 as amended, for rezoning 1.37 acres from Residential (R20) Zone District to Commercial Services (CS2) Zone District. Commissioner Ford seconded the motion.
Motion carried with all in favor.

The next item of New Business for Consideration was RS07043, a Zone Change Request for parcels 08-1.0-11.0-079., 08-6.0-14.0-002., and 08-6.0-14.0-002.01, located at 2800 Frisco Hill Road, in Imperial Township, from Rural Residential (RR2) Zone District to Residential (R40) Zone District.

The following individual testified in favor of RS07043: Gene Fribis, John V. Price
The following individuals testified in opposition of RS07043: Thomas M. Busken, Robert Hermann, Lester Sitzes
Commissioner Geatley made a motion that the Jefferson County Planning and Zoning Commission finds that the proposed zone change is consistent with the purpose and intent of the Residential (R40) Zone District and recommends approval of RS07043. Commissioner Dugan seconded the motion.
Motion carried with all in favor.

The next item of New Business for VR07044, A Variance Request for parcel 17-7.0-35.0-006.02, located at the end of the Walker Hill Drive, southeast of Fountain City road in Valle Township, for relief from Appendix A. Right of Way and Road Standards (Minimum Radius of Curve an Minimum Street Pavement Standards) of the Jefferson County Subdivision Regulations.

Mr. Ament Presented the staff report for VR07044. The following individual testified in favor of VR07044: Dan Govero
Commissioner Price made a motion that the Jefferson County Planning and Zoning Commission recommends approval of VR07044 subject to staff conditions and recommendations. Commissioner Lesch seconded the motion.
Motion carried with all in favor.

Under reports to the commission articles of the UDO were discussed.

Under citizens to be heard, Mike Faulkner addressed concerns the HBA had regarding proposed zone district reclassifications.

There being no further business Commissioner Dugan made a motion to adjourn. Commissioner Price seconded the motion.
The April 24, 2007, Planning and Zoning Commission meeting adjourned at 9:30 p.m.
